Terms for business clients

1. Scope

These terms apply to every order with Tallmint Studio (legal notice). We work only with businesses under § 14 BGB. Your own terms do not apply, even if we do not object to them.

2. Contract

Prices and packages on this website are not an offer. A contract is formed when we confirm your order by email.

3. Production

Each short is a vertical video of 30 to 60 seconds with voice and captions. We write the script, and you approve it. You then get a first cut with one round of changes. Further changes, or a new script after approval, are charged separately. We decide on style, voice and music.

4. Your part

You provide the product information and materials we need and reply within five working days. Our timeline extends by the time we wait for you. You are responsible for your materials and for the product claims you give us or approve; they must be true and must not infringe the rights of others. You grant us the right to use your name, logo and materials for the production, publication and presentation of the short. If third parties make claims against us because of your materials or claims, you indemnify us, including reasonable legal costs.

5. Approval

A script, cut or final file counts as approved if you do not ask for changes within five working days of receiving it.

6. Publication

We publish each short on TrueFlicks on YouTube, TikTok and Instagram, and on Plain Nobody if it fits that channel. We mark every short as paid promotion and choose the date, title and description. We owe no views, reach or placement. We may take a short down if a platform or the law requires it.

7. Prices and payment

Prices are in US dollars, as listed on this website when you order, plus VAT where it applies. We invoice in advance, also through a payment provider. Invoices are due within seven days, and we start once payment is received.

8. Monthly package

The monthly package runs from month to month. Either side can cancel by email no later than seven days before the next billing date. A short you have not briefed within two months of paying for it lapses.

9. Rights of use

All rights in scripts, animation, voice and music remain with us. Once paid in full, you receive a non-exclusive, worldwide and unlimited right to use the final file on your own channels and website and in your ads, including shortened or cropped versions. You may not pass this right on to others. We may keep each short online and show it as a reference.

10. Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slight negligence we are liable only for breach of an obligation essential to the contract, limited to the typical foreseeable damage and to the price of the order concerned. Claims for defects become time-barred one year after approval, except for intent and injury to life, body or health.

11. Final provisions

German law applies; the UN Convention on Contracts for the International Sale of Goods does not. The exclusive place of jurisdiction is our place of business; we may also sue at yours.
